Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Kerf & Co LLC (“Kerf & Co,” “we,” “us”), a Westown Labs company, governing your use of the CabCuts mobile app and related services (the “Service”). Please read them carefully. By downloading or using CabCuts, you agree to these Terms.

1. Agreement to these Terms

By accessing or using CabCuts, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

CabCuts is a planning tool that generates cabinet cut lists, sheet-goods and linear material layouts, and 3D previews from dimensions and options you enter. It offers a free tier and an optional paid subscription (“CabCuts Pro”) with additional features, including cloud backup and sync.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and able to form a binding contract to use CabCuts. If you use the Service on behalf of a business, you represent that you are authorized to accept these Terms for it.

4. Accounts

Most of CabCuts works without an account. If you sign in to use cloud backup, you are responsible for maintaining the security of your sign-in method and for activity under your account. Notify us promptly of any unauthorized use.

5. Subscriptions, free trial & purchases

• CabCuts Pro is an auto-renewing subscription priced at $4.99 USD per month (prices may vary by region and are shown in the app before purchase), offered with a 1-month free trial for eligible new subscribers.
• Billing & renewal. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase (or at the end of the free trial). The subscription auto-renews for the same period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Managing & canceling. You can manage or cancel your subscription, or turn off auto-renewal, in your App Store or Google Play account settings after purchase. Canceling stops future renewals; it does not retroactively refund the current period.
• Free-trial terms. If you buy a subscription during a free trial, any unused portion of the trial is forfeited when the paid subscription begins.
• One-time export unlock. The free tier can unlock exporting for a single build via a one-time in-app purchase (currently $0.99 USD). This is a consumable purchase tied to that build and is not a subscription.
• Refunds. Purchases are processed by Apple and Google; refunds are handled under their policies. We generally cannot issue refunds directly for store purchases.

6. License to use the app

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use CabCuts on devices you own or control, for your personal or internal business use. You may not sell, sublicense, or redistribute the app.

7. Acceptable use

You agree not to: (a) copy, modify, reverse-engineer, decompile, or attempt to extract the source code of the app except to the extent that restriction is prohibited by law; (b) use the Service to violate any law or infringe anyone’s rights; (c) interfere with or disrupt the Service or its infrastructure; or (d) attempt to gain unauthorized access to any systems or other users’ data.

8. Your content

You retain ownership of the cabinet designs and other content you create in CabCuts. When you subscribe to CabCuts Pro, your projects are backed up to our servers, and you grant us a limited license to store, copy, transmit, and process that content solely to provide the Service to you (for example, to back it up, restore it, and sync it across your devices). We do not claim ownership of your designs.

9. Intellectual property

The CabCuts app, its calculation engine, design, and the CabCuts name and logo are owned by Kerf & Co LLC and its licensors and are protected by intellectual-property laws. Except for the license above, these Terms grant you no rights in our intellectual property.

10. Measurements, results & no professional advice

Woodworking and the operation of power tools involve inherent risks. You are solely responsible for your designs, your material purchases, your cuts, and your safety. CabCuts does not provide engineering, structural, safety, or professional advice. We are not responsible for material waste, mis-cuts, incorrect orders, project outcomes, injuries, or any other losses arising from your use of the results.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or meet your requirements.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KERF & CO AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST MATERIALS, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) US $25. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Kerf & Co and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.

14. Termination

You may stop using CabCuts at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

15. Changes to the Service or these Terms

We may modify or discontinue features of the Service, and we may update these Terms from time to time. When we make material changes, we’ll revise the “Last updated” date and provide notice in the app. Your continued use after changes take effect means you accept the updated Terms.

16. Governing law & disputes

These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in [STATE / COUNTY] will have exclusive jurisdiction over any dispute not subject to the app-store terms below, except where prohibited by applicable consumer-protection law.

17. Additional app-store terms

Apple App Store

These Terms are between you and Kerf & Co only, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product-liability, legal or regulatory, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S.-government embargo or designated as “terrorist supporting,” and that you are not on any U.S.-government list of prohibited or restricted parties.

Google Play

If you obtained CabCuts through Google Play, your use is also subject to the Google Play Terms of Service, and Google is not responsible for the app or its content.
